Chandigarh – 18.6.2019 – Three fraudsters namely, Sandeep, Mandeep and Amit, who were cheating the unemployed persons by issuing advertisement for inviting applications for recruitment in “Sarve Saksharta Computer Education Abhiyan”, stand convicted by Panchkula Court-Impact of PIL filed by Advocate H.C. Arora:
The three fraudsters namely Sandeep, Mandeep and Amit, who had set up Sarve Saksharta Computer Education Abhiyan, in the year 2012, and issued advertisements for inviting applications for 2532 posts, for the purpose of deceiving the common people by naming their organization, with resemblance with the name of Government Organization Sarv Sikhiya Abhiyan Authority, Punjab, have ultimately met the fate for which they were destined. Sh. Viren Kadyan, JMIC, Panchkula has convicted them for offence of fraud under Section 420 IPC, and sentenced them to 3 years’ rigorous imprisonment along with a fine of Rs. 10,000/- each. The order was passed by the Court of JMIC (Judicial Magistrate Ist Class) on 8.5.2019, which has come to the light now.
That sum and substance of this case is that on coming to know about the notorious attempt being made by these persons to commit fraud with the unemployed persons, by inviting applications for recruitment, which were to be accompanied by application fee comprising Rs. 400/- for General Category and Rs. 300/- for SC Category. In this manner, as per judgment, these people succeeded in collecting a huge amount of Rs. 43.31 lakhs. On coming to know about this fraud, Advocate H.C. Arora, had filed a PIL (Public Interest Litigation), upon which the directions was issued by the High Court, and FIR was registered by Panchkula Police. These persons tried to escape the clutches of law by changing the name of their Society, and also by dropping the words “Government of India”, which they had inserted in the advertisement below the name of their society. The High Court had decisively intervened in the matter and ensured the return of the application money to all unemployed persons who had submitted their applications for recruitment against various posts under the society set up by these persons. Besides, an FIR was registered against these persons, who were the Directors of the Society, on 20.9.2013. After investigation, the challan was put up, and charges were framed under Section 420/120-B of Indian Penal Code in July, 2017. After this now, on conclusion of the trial , these three persons have been convicted under Section 420/120-B IPC and sentenced to three years’ rigorous imprisonment along with fine of Rs. 10,000/- each. Advocate H.C. Arora had also been summoned as a prosecution witness as PW-11 in the above case and he was cross-examined also by defence . He deposed about the facts relating to the filing of the Public Interest Litigation by him, and the orders passed by the High Court in PIL in relation to the fraud committed by these persons by misusing the resemblance of the name of their society, with Sarv Sikhiya Abhiyan Authority Punjab.
The accused have been released on bail by the Court of Sh. Viren Kadyan, JMIC, Panchkula.
