Jail not bail : High Court rejects bail application of accused facing life imprisonment in Nishan Singh’s murder case : Abhilaksh Gaind
Ferozepur, December 14, 2019: The High Court has rejected the bail application of Kabul Singh facing life imprisonment as per Session Court orders in the case of killing of Nishan Singh on May 28, 2015, a prominent farmer of Ashike village of Mallanwala block near Ferozepur.
Kabul Singh along with nine other accused - Baldev Singh, Gurjej Singh alias Gora, Kabul Singh, Gurjej Singh, Harpal Singh, Gurpal Singh, Jagraj Singh, Satnam Singh and Nirmal Singh - were sentenced to life imprisonment for murder of Nishan Singh and are currently serving a life sentence in the jail, as per decision of Session Court order on August 8, 2019. The land dispute said to be the cause behind the killing.
Akhilaksh Gaind, Advocate appeared in the case of Baldev Singh Vs State of Punjab, on behalf of the complainant Raj Kaur wife of deceased Nishan Singh in an appeal application of Kabul Singh in the High Court challenging the decision of Session Court, for seeking bail, citing the police investigation report and medical condition of the accused.
Counsel for Raj Kaur stated that he argued that accused Kabul Singh had played an important role in the killing by attacking Nishan Singh with ‘kapa’ in his hand and releasing him on bail would be unfair to the decease and his family, when he has rightly been sentenced by the Session Court.
In this case, there is a charge of killing Nishan Singh by rolling twice the tractor on him. In this incident, Nishan Singh’s wife Raj Kaur and daguther Kulwinder Kaur were also badly injured. The police had registered the case on their statement against nine persons including Kabul Singh, who has filed an appeal in the High Court for seeking bail. Therefore, the High Court denied the bail to Kabul Singh.
