Ferozepur, April 26, 2017: With the filing of a petition in the Punjab and Haryana High Court by Surjit Kumar Jyani, challenging the date of birth, has landed Congress MLA Davinder Ghubaya in trouble.
The petition mentions that Davinder did not qualify the mandatory age of 25 years for contesting the Assembly poll and the same has been accepted for scrutiny on May 23.
Fazilka MLA Davinder defeated Jyani with a narrow margin of 265 votes in the Assembly elections. The controversy had also erupted at the time of filing of nomination papers by Davinder but the his nomination papers were accepted by the RO. His father, Sher Singh Ghubaya, is an SAD MP from Ferozepur.
The controversy cropped up over Davinder’s certificates of Class VIII and X and BA mentioned his date of birth as July 31, 1993 while it is claimed that the Congress MLA’s age had been mentioned as 23 years in voter list issued on January 5, 2017,allegedly making him ineligible to contest elections.
On the other hand, Davinder, however, has repeatedly said his date of birth is December 13, 1991, as per his birth certificate. Earlier also, Davinder had denied the allegation of obtaining any false certificate to become eligible for contesting the election.
Now the ball is in the court to decide the matter.
