Police first authority to decide who should be allowed to enter Delhi : SC on Jan 26 Tractor March
Chandigarh, January 18, 2021: While hearing the petition seeking an injunction against the proposed tractor rally or any other kind of protest which sought to disrupt the gathering and celebrations of the Republic Day on January 26, Supreme Court told that the centre the government has liberty to invoke all the powers under the law.
A three-judge bench headed by Chief Justice of India Sharad Arvind Bobde was hearing the pleas raising the issue of farmers protesting at Delhi borders.
“The question of entry into Delhi is a law and order situation that is to be determined by the police,” said SA Bobde while hearing the application.
Similarly, Attorney General KK Venugopal while appearing for the Centre said that the tractor rally proposed by farmers will be illegal and there will be the entry of 5000 people in Delhi.
To which CJI replied," We have told the AG and SG before that whether who should allow and who should not be allowed and the number of people who can enter are all matters of law and order to be dealt with the by the police. We are not the first authority."
The Centre, in an application filed through Delhi Police, has said that any proposed rally or protest which seeks to disrupt and disturb the Republic Day celebrations will cause an "embarrassment to the nation".
