Session Court Awards Life Imprisonment to a migrant for murdering his brother

The Court of District and Sessions Judge, Shaheed Bhagat Singh Nagar, Kanwaljit Singh Bajwa on Monday awarded life imprisonment to a migrant for murdering his brother on February 5, 2021.
The accused has been identified as Shiri Pal ( 31 years)son of Nathu Lal son of Hori Lal, resident of village Biharipur, Post Office Khajuria, Police Station Bisoli, District Badayu (Uttar Pradesh), at present resident of village Simbal Mazara, Police Station Balachaur, District Shaheed Bhagat Singh Nagar.
As per case details, a case under sections 302 of the Indian Penal Code was registered at Balachaur Police station on the complaint of Manjit Singh son of Parkash Singh, resident of village Simbal Mazara, Police Station Balachaur. The complainant stated that both the accused Shiripal and deceased namely Taliban resident of village Dharampur (Uttar Pradesh) were staying together at the waterpump room of the agricultural land owned by one Piara Singh of England and being cultivated by him at Simbal Mazara where the accused murdered Taliban during the intervening night of February 4 and 5 of 2021.Taliban was having injuries on his head and near the left eye and a lot of blood was lying on the ground. He was also happened to be real brother of the accused Shiripal. Further, since Shiri Pal, real brother of Taliban was not found present at the spot, as such, they suspected that Taliban had been killed by Shiri Pal and that after committing crime he had absconded.
Earlier also both the brothers used to have dispute over the money distribution. The accused was arrested by the Police on 05.02.2021.
During the trial, the following point arose for deciding the case before the learned Session Judge; “Whether during intervening night of 04/05.02.2021 in the area of village Chankoya, Police Station Balachaur, accused Shiri Pal committed murder by intentionally and knowingly causing the death of Taliban son of Nathu Lal and thereby attracted the provisions under Section 302 of the Indian Penal Code"?
Pronouncing the quantum of sentence, on Monday, the District and Session Judge, Kanwaljit Singh Bajwa, asserted, “keeping in view the gravity and nature of the offence committed by him, convict Shiri Pal is not entitled to any leniency. However, not finding it to be a case falling under the category of “rarest of rare case”, warranting Capital Punishment, convict Shiri Pal is sentenced to life imprisonment under offence under Section 302 of IPC with a fine of Rs 10,000. In case of default payment of fine, Shiri Pal will have to undergo punishment of one more year. The session Judge also made it clear that the period already undergone by the convict during the Investigation/trial shall be set-off from the substantiate sentence to be undergone by him, as envisioned under Section 428 of the Code of Criminal Procedure.
