Chandigarh, March 3, 2024 – Hemant Kumar, Advocate in Punjab and Haryana High Court questioned if the next secretary of Haryana Assembly be selected before the implementation of the Model Code of Conduct.
Notably, the retirement of the current Secretary of the Haryana Assembly Rajendra Kumar Nandal is scheduled at the end of March this month.
Nandal, who served for more than seventeen years in various senior posts in the Assembly Secretariat, in November 2006, i.e. during the government of Bhupendra Hooda and when Dr. Raghubir Singh Kadyan, Congress MLA from Beri assembly constituency of Jhajjar district, was the speaker of the then 11th Assembly.
Nadal was directly appointed to the post of Deputy Secretary in the Assembly Secretariat, after which he was promoted to Joint Secretary in January 2010, then Additional Secretary in February 2012, and Secretary in August 2014.
However, meanwhile, Punjab and Haryana High Court Advocate Hemant Kumar (9416887788) said that when Nandal became the Assembly Secretary in August 2014, Sumit Kumar, who had completed more than 25 years of tenure on the post of Secretary, was also serving. And he then had two and a half years of service left.
However, after Nandal became the Secretary, Sumit was promoted as the Principal Secretary and he remained on that post till January 31, 2017.
Sumit was directly appointed Assembly Secretary in April 1989 during the government of Tau Devi Lal and when Harmohinder Singh Chattha was the Speaker of the then 6th Assembly and he held this post for 28 consecutive years, which is a record in itself.
However, it would be worth seeing whether the selection and appointment process of Nandal's successor is completed before his retirement from the post of Assembly Secretary. Since the announcement of the 18th Lok Sabha general election by the Election Commission of India can be made any time before the middle of this month and with the announcement the Model Code of Conduct will be implemented in the entire country and after that the regular appointment to the post of Assembly Secretary will be made in the month of May. Till the end i.e. the completion of the Lok Sabha election process may be pending.
Hemant said that according to Haryana Assembly Secretariat Service Rules, 1981, although all the posts of the Assembly can be appointed by the Speaker, but as far as the post of Assembly Secretary is concerned, the Secretary is appointed to this post by the State Government in consultation with the Speaker. Is performed.
As far as the qualifications and experience prescribed for Assembly Secretary is concerned, Hemant said that appointment to this post can be done by direct recruitment, by promotion, by transfer and by deputation. As far as direct recruitment is concerned, it requires a Bachelor of Laws i.e. Law Degree (Professional) along with eight years of experience in supervisory capacity and practical knowledge of secretariat administration, parliamentary procedure and rules of assembly or in a subordinate court. Must have 10 years of practice as an advocate or 5 years of practice as an advocate in High Court. As far as appointment to the post of Assembly Secretary is concerned through promotion, an Additional Secretary with one year experience in the Assembly Secretariat is eligible for this post. Apart from this, an IAS officer of state cadre of appropriate grade and Assistant Advocate General, Deputy Advocate General and Senior Deputy Advocate General posted in the Advocate General's office of the state, who is eligible to be appointed as Public Prosecutor, can also become Assembly Secretary on transfer basis. Is. Similarly, a judicial officer of the senior Judicial Service cadre of the state i.e. Additional District and Sessions Judge rank can also become the Assembly Secretary on deputation.
