Here’s everything you need to know about HC’s judgement on former DGP Sumedh Saini
Chandigarh, September 11, 2021: The Punjab and Haryana High Court is presently in the news for its latest judgement giving blanket bail to former Punjab Director General of Police (DGP) Sumedh Singh Saini.
The judgement has certainly come as an embarrassment to Punjab Government and the State Vigilance Bureau in land scam case in which Saini was arrested last month. Some are even terming it as a ‘Rare Judgement’ pronounced by the High Court.
Here’s are some of the highlights of the much-talked judgement of Punjab and Haryana High Court at this time:
- The High Court has ordered complete stay on any investigation in all the FIRs pending against former Punjab DGP.
- The stay will remain in place till the general assembly elections in Punjab that are due in February 2022.
- The court order issued by Arvind Singh Sangwan noted that multiple cases against Saini could be a political ploy in the wake of upcoming Assembly Elections.
- The order was passed after hearing the petition filed by Saini seeking direction to hand over the investigation in any matter registered against him in CBI to any other independent agency outside Punjab apprehending false implication in criminal cases on account of malice, mala fides and ulterior motives on account of party which is in power in the state.

- The court stated that there will be a clear stay for the arrest of Saini in all cases pending or likely to be registered or where he is sought to be implicated with the aid of Section 120 of IPC.
- The High Court’s order however does not provide security to Saini in the Multani murder case that is pending before the Supreme Court.

- Saini has been directed not to leave the country without court’s prior permission.
- The next hearing in the matter has been slated to December 13, 2021.

Excerpt from the order:
‘After hearing the learned counsel for the parties, I find merit in the submissions made by learned senior counsel for the petitioner that involvement of the petitioner in multiple cases can be a political ploy in wake of the coming State Legislative Assembly General Elections. I am also conspicuous of the dare shown by the Punjab Police officials in trying to overreach the Court as noticed above which is also a circumstance to be considered about the nature and quality of investigation being conducted by the Punjab Police in the FIRs, therefore, I deem it appropriate to pass the following directions:-
“Considering it to be a case of exceptional circumstances and hardship being caused to the petitioner by the State of Punjab (on political grounds),
there will be a clear stay for the arrest of the petitioner in all cases pending or likely to be registered or registered or where he is sought to be implicated in the aid of Section 120-B IPC except FIR No.77, where the matter is pending before the Hon'ble Supreme Court, till the General Election in the State of Punjab are held which are due in February, 2022 onwards,” read the orders issued by Justice Arvind Singh Sangwan.
