INLD Meets President Pranab Mukherjee
Chandigarh, March 19, 2016: Led by senior leader of the Indian National Lok Dal (INLD) and leader of opposition in the State Assembly, Shri Abhay SIngh Chautala, a high-powered delegation of the party met the President of India Shri Pranab Mukherjee at Rashtrapati Bhawan, New Delhi. The main issue behind meeting the President was the ongoing crisis over the issue of the SYL Canal. Besides all the MP's and MLA's of INLD, other leaders in the delegation included INLD State Presient Shri Ashok Arora, Hisar MP and leader of the party in the Parliament Shri Dushyant Chautala and former CPS Shri Rampal Majra. During meeting with the President, the INLD delegation requested Shri Pranab Mukherjee that Punjab government should be dismissed besides the dissolution of the state assembly for grossly violating the Federal Structure over the issue of the SYL Canal. Apart from the SYL Canal issue, the INLD delegation apprised the President about the tragic and violent agitation that took place in Haryana last month over the issue of the reservation for the Jats and five other caste. The INLD leaders requested Shri Pranab Mukherjee for setting up a Judicial Commission for a thorough probe into all incidents of violence. "Neither the Haryana government kept its words over giving reservation to Jats and five other caste, nor the government managed to maintain law and order and safeguard the life and property of the people", Shri Abhay Chautala told the President. He further said that INLD was of the firm view that probe of those involved in delivering inflammatory speeches and the role of the political leaders during the agitation by the Judicial Commission. -GP
Copy of Memo. to President To, Hon’ble President of India, Rashtrapati Bhawan, New Delhi. Subject: (I) Regarding blatantly unconstitutional actions of Punjab Government and Assembly concerning the Sutlej-Yamuna Link (SYL) Canal land; (II) Constitution of Judicial Commission regarding violent incidents following the Reservation agitation of February 2016 in Haryana. Sir, The Indian National Lok Dal (INLD), on behalf of the people of Haryana, draws your attention towards the unprecedented events related to share of river waters of Haryana from the Ravi and Beas rivers and the Reservation agitation. Both the events have created havoc in the minds of the people and require decisive action and unambiguous direction. To briefly recall the events that have now culminated in the blatantly unconstitutional act of Punjab Assembly in passing the Punjab Sutlej-Yamuna Link Canal Land (Transfer of Propriety Rights) Bill, 2016, are as follows: The river waters dispute between Haryana and Punjab had been pending in the Hon’ble Supreme Court after the Hon’ble Punjab and Haryana High Court had given its judgment in favour of Haryana regarding the completion of the Sutlej-Yamuna Link Canal (SYL). Finally, the Hon’ble Supreme Court too gave its judgment in 2002 in favour of Haryana and also directed Punjab to complete the construction within a year failing which the Government of India was directed to get it completed by a central agency like Border Roads Organization (BRO). Following this, the Punjab government filed a review petition which was turned down by the Hon’ble Supreme Court. With all legal recourse exhausted, and when the Government of India was bound by the ruling of the Hon’ble Supreme Court, Punjab resorted to an act in 2004 that was seen to be an assault on the Constitution of India. The Punjab Termination of Agreement Act, 2004 was patently an unconstitutional attempt to subvert the Constitution and its federal character. Faced with this unprecedented situation, the then Hon’ble President referred The Punjab Termination of Agreement Act to the Hon’ble Supreme Court to seek its opinion on its constitutionality. Unfortunately, for twelve long years the matter could not be taken up by the Hon’ble Supreme Court. The Indian National Lok Dal (INLD) has from time to time appealed to successive central governments to approach the Hon’ble Supreme Court for expediting the reference under its consideration. You will recall that Shri Dushyant Chautala, Member of Parliament (Lok Sabha) of the INLD, too had appealed to you vide letter No. MP/1/2015/ND/240, dated 24-3-2015 requesting your office seeking early decision on Presidential Reference. It was only now when the subject came for hearing and apprehending an adverse advice by the Hon’ble Supreme Court, the State of Punjab in a move to pre-empt it, passed the Punjab Sutlej-Yamuna Link Canal Land (Transfer of Propriety Rights) Bill, 2016. The Bill provides for the return of 5,376 acres of land acquired for the purpose of the link canal. The unconstitutional Bill now stands referred to the Governor of Punjab for his assent. This has been followed by a total breakdown of constitutional machinery in Punjab. Egged, encouraged and supported by the leaders of all political parties of Punjab, the farmers from the villages through which the canal had been constructed, resorted to reclaiming the canal land by cutting down the full grown trees on its banks, inflicting incalculable ecological damage, and filling it with the use of earth moving heavy machinery. Thankfully, the Hon’ble Supreme Court took immediate notice and directed the appropriate authorities to ensure status quo. Preceding the unconstitutional action of Punjab, the State of Haryana was already going through a traumatic experience of witnessing total collapse of law and order and constitutional failure in the wake of an agitation seeking Reservation for Jats and other castes. Because of this failure, more than 30 precious lives have been lost and property worth thousands of crore of rupees has since been destroyed. It would not be inappropriate to bring to light the fact that since 1990 the Jat and other castes have been periodically promised and betrayed on this subject. But, betrayals notwithstanding, nothing justifies the failure of the Haryana Government in protecting lives and property in the State. Faced with this twin crisis, the Indian National Lok Dal (INLD) and the people of Haryana approach you with the hope that your intervention will hasten a process that re-establishes the authority of the Constitution in the face of its perverted subversion by Punjab. We appeal to you to invoke the constitutional provision to dismiss the Punjab Government and dissolve the Assembly that has attempted to destroy the federal character of the Constitution and pre-empt possible adversarial judgement of the Hon’ble Supreme Court. A central government agency may please be tasked with the restoration of the SYL canal so that without wasting any time the parched fields of Haryana are irrigated soon after the verdict of the Presidential Reference. In the wake of the failure of the Haryana Government maintaining law and order and coming good on the promise to the Jats and others on the question of Reservation, a judicial Commission headed by a sitting judge of the Hon’ble Supreme Court or High Court be constituted to go into the events that culminated in violence. Timeline of the events and the provocative statements of various leaders and their role before and during the agitation be also gone through by the said Commission. The INLD and the people of Haryana look towards you as the custodian of the Constitution to exert your influence and authority in redressing the grievances of the people of Haryana.
