Tenure of MP elected in Haryana Rajya Sabha by-election to be one and half years: HC Advocate

Chandigarh, August 9, 2024: As the Election Commission of India (ECI) announces the schedule for the by-election for a Rajya Sabha seat from Haryana which has been vacant for the last two months, Punjab and Haryana High Court Hemant Kumar stated that the tenure of MP elected in Haryana Rajya Sabha by-election to be one and half years.
"The tenure of the MP elected for the said Rajya Sabha seat from Haryana will be about one and a half years i.e. till April 2026 because Lok Sabha MP Deepender Hooda, who was elected two months ago from Rohtak Lok Sabha seat, has been removed from the above mentioned seat due to his becoming a Lok Sabha MP. The Rajya Sabha seat has fallen vacant, his Rajya Sabha term was only till 9 April 2026, hence the said Rajya Sabha by-election is being held for his remaining term only," said Hemant Kumar.
The Election Commission of India has announced the schedule for the by-election for a Rajya Sabha seat from Haryana which has been vacant for the last two months. Nominations will be filed from 14th to 21st August while their scrutiny will be done on 22nd, interested persons can apply till 27th August. his candidature can be withdrawn by the candidate and if required, i.e. two candidates are in the fray
So the voting will be held on 3rd September and after the voting on the same day, the counting of votes and results will be declared.
Hemant Kumar said that based on the current strength of political parties in the Haryana Assembly, the possibility of voting in the upcoming Rajya Sabha by-election is very low or almost nil. This situation may arise. Since at present the main opposition Congress party with 28 MLAs (29 before Kiran Chaudhary left Congress) or if all the opposition parties come together and field a joint candidate for the by-election of the said Rajya Sabha seat, then that candidate will have to face the support of all the Congress MLAs. Despite getting 28 votes, all 10 of JJP, one of INLD and all 4 independent MLAs' votes, he will still be behind the BJP candidate by one vote.
With Kiran Chaudhary switching sides while being an MLA and joining the BJP camp, the number of MLAs supporting the Naib Saini government in the current 87-member Haryana Vidhan Sabha is currently 44, out of which BJP has 41 MLAs of its own while apart from Kiran, there is one MLA. Independent Nayan Pal Rawat and HLP's Gopal Kanda are supporting the government. Hemant also said that since political parties cannot issue whips to instruct their MLAs regarding voting in Rajya Sabha elections, Congress is not going to form a government. And in the voting by JJP MLAs, if it takes place, cross-voting cannot be ruled out.
However, if only the BJP candidate is nominated in the by-election for the above Rajya Sabha seat, he will be declared elected unopposed by the Returning Officer (R.O.) on the last day of withdrawal of candidature i.e. on 27th August itself and the Election Certificate will be issued to him. letter) will be provided.
However, there is speculation that the BJP may field either Kiran Chaudhary, currently MLA from Tosham seat in Bhiwani district, or her daughter and former Lok Sabha MP Shruti Chaudhary, both of whom had quit the Congress and joined the BJP in June last year. The party can make him a Rajya Sabha candidate. However, Kuldeep Bishnoi, who left the Congress and joined the BJP two years ago in August 2022, is also trying hard to go to the Rajya Sabha. Kuldeep was elected as a Lok Sabha MP in 2004 and 2011.
