HC Advocate flags error in Haryana Govt website, seeks correction in department name

Chandigarh, November 4, 2025: In a formal legal representation addressed to Shri Dharminder Chaudhary, Director of Prosecution (General), Haryana, advocate Hemant Kumar from the Punjab and Haryana High Court has raised concern over an erroneous mention of “Prosecution Department, Haryana” on official government documents and the department’s website — https://prosecutionhry.gov.in/.
The memorandum dated November 4, 2025, highlights that as per the Business of the Haryana Government (Allocation) Rules, 1974 (as amended), there is no department named “Prosecution Department” in the state. Instead, the Directorate of Prosecution functions under the Home Department, which is the Administrative Department (A.D.) for all prosecution-related matters.
Hemant Kumar, in his communication, stated that referring to the Directorate as a separate department is legally incorrect and inconsistent with constitutional and administrative provisions.
He further cited Section 20 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, which clearly specifies that every state’s Directorate of Prosecution operates under the administrative control of the Home Department. The same structure was earlier reflected under Section 25A of the repealed Code of Criminal Procedure (CrPC), 1973.
The advocate has urged the Director of Prosecution to take cognizance of the issue and initiate corrective action at the earliest to ensure administrative accuracy and adherence to the 1974 Rules framed under Article 166(2) and (3) of the Constitution of India.
